Sale, importation and manufacture of radio equipment

Manufacturers, importers and sellers of radio equipment must ensure that interference-free and compliant radio equipment is available to consumers. Only compliant radio equipment may be sold in Finland. FICORA supervises the compliance of radio equipment sold in Finland.

The free movement of goods is one of the primary principles and goals of the European Union. As of 13 June 2016, radio equipment is placed on the European market in accordance with the Radio Equipment Directive RED 2014/53/EU. During the transitional period, 13 June 2016–12 June 2017, radio equipment can also be placed on the market in accordance with the repealed Radio & Telecommunications Terminal Equipment Directive R&TTED 1999/5/EC. Only RED-compliant radio equipment may be placed on the market in the EU as of 13 June 2017. The Radio Equipment Directive has been implemented in Finland through national legislation:

Placing radio equipment on the market

Placing on the market means that an item of radio equipment is made available for the first time on the European market. The radio equipment must conform to the applicable requirements based on the Radio Equipment Directive when it is placed on the market. Conformity is indicated by a CE marking on the radio equipment and an EU declaration of conformity supplied with the equipment.

Obligations for manufacturers, importers and distributors

The manufacturer of radio equipment must ensure the conformity of the equipment and ensure that all of the required documentation, information and markings are supplied with the equipment. The importer and distributor must ensure that the manufacturer has fulfilled these obligations. The obligations are specified in the Information Society Code 917/2014.

  • Manufacturer means any natural or legal person who manufactures radio equipment or has radio equipment designed or manufactured, and markets that equipment under his name or trademark.
  • Authorised representative means any natural or legal person established within the EU who has received a written mandate from a manufacturer of radio equipment to act on his behalf in relation to specified tasks.
  • Importer means any natural or legal person established within the EU who places radio equipment from a third country on the EU market.
  • Distributor means any natural or legal person in the supply chain, other than the manufacturer or the importer who makes radio equipment available on the market.
  • Importers and distributors of radio equipment are considered equal to the manufacturer and are subject to the same obligations as the manufacturer of radio equipment when they place radio equipment on the market under their own name or trademark, or modify radio equipment already placed on the market in a way that may affect its conformity.

Tests product samples, if necessary, investigates complaints, non-compliant radio equipment and recalls of radio equipment and keeps a record of them, as well as informs distributors of all such supervision x x x
