Users and subscribers of communications services

A user of communications services means a natural person who uses a communications service. The service user retains his or her right to confidential communications even when the service is subscribed by another person.

Often, the subscriber and the user of the service are the same person, but there are exceptions to this.

Often the subscriber of communications services may, for example, be

  • a company or an organisation functioning as an employer;
  • a school;
  • parents.

In these cases, the subscriber pays the bills for using the service, but does not actually use the subscription.

Because the subscriber pays the bills, he or she must be informed whether

  • the invoicing is based on actual use of services;
  • the user has used the service as agreed.

Although the subscriber needs the information, the user has the right to confidential communications. Therefore, the right of the subscriber of a communications service to obtain information has been restricted in cases where another person uses the subscription.
